My sons school hasn’t got a CCTV sign, how illegal is this?

My sons school has CCTV cameras on the outdoors which look into the public roads also, yet have absolutely no signs warning of this. I believe this is against the Data Protection Act of 1998? If im right and what they’re doing is illegal, what should i do about it?

Contrary to another answer, CCTV does come within the remit of the Data Protection Act (DPA), but only if the images are recorded. If they are recorded then the recordings contain personal information (ie pictures of individuals) which is being stored in some kind of organised system (eg tapes with dates on them).

Its quite possible that the “camera” is a dummy, in which case the DPA is not relevant. Its also possible that nothing is being recorded. IE the camera merely sends a live feed to the secretary’s office so they can see who is coming and going. Again, this does probably does not fall under the DPA.

It may be that, while the cameras point towards the road, they are not sensitive enough to record any personal data (ie recognisable faces or car number plates) at that distance. In which case the DPA is probably not being breached.

If images are being recorded then the use of CCTV does fall within the DPA whether the cameras are pointed at the public road or at the school premises. In which case there should be a notification that CCTV is in use. In public areas this is normally done with signs, so a lack of signs would be a breach of the DPA. The correct thing to do is to report the school to the Information Commissioner’s Office ( http://www.ico.gov.uk ).

If images are being taken of school grounds only then the notification requirement could be met in other ways. For example, all parents might be given a letter when their child joins the school informing them that CCTV is in use on school premises.
